Standard Conditions of Entry - Game of Skill
- Information on how to enter and prizes form part of these conditions of entry. By participating, entrants agree to be bound by these conditions of entry. Entries must comply with these conditions of entry to be valid.
- Entry is open to residents of Australia who are 18 years and over who are current Health and Community Services sector students at an Australian University, or who intend to enrol as Health and Community Services sector students at an Australian University in 2010. The directors, management and employees (and their immediate families) of the promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
- The promotion commences on 23/2/2010 and closes at 23.59 (aest) on 18/06/2010 ("entry period").
- To enter the promotion, an entrant must, during the entry period, either:
- At a promoter run event held on the campus of Monash University on 23/2/2010 or on the campus of Deakin University between 15/3/2010-18/3/2010 (inclusive), sign up to become a member of the Health Super Student Club by correctly completing the entry form and submitting the entry form into the box provided. After an entrant has submitted an entry form the entrant will be invited to provide their answer to the question "things i love" and have their photo taken in the promoter's photobooth. The photo may be publicly posted at the relevant campus and on the promoter's website. An entrant will then receive an entry in the promotion after successfully having a photo taken in accordance with the above; or
- Go to healthsuperclub.com.au, register to join the Health Super Student Club or log in to the Health Super Student Club after 18/03/2010 (aest) but before 23.59 (aest) on 18/06/2010 and correctly complete the online entry form including (i) uploading a photograph of the entrant; and (ii) stating in words "things i love". An email will be sent to each entrant who submits an online entry and who has their photograph accepted by the promoter as a valid entry to be publicly posted on the promoter's website. An entrant will then receive an entry in the promotion.
Entrants acknowledge that any photographs uploaded to the promotional website or taken in the promoter's photobooth are not private photographs and can be viewed by others on the internet and on the campus where the photograph was taken (where relevant). Under no circumstances will the promoter be liable in any way for any content provided by an entrant, including, but not limited to any loss or damage of any kind incurred as a result of the review and/or use of such photographs.
Only one (1) entry per person permitted. Any subsequent entry after the first valid entry is received will be deemed invalid.
Entries must be received by the promoter during the entry period.
This promotion is a game of skill. Chance plays no part in determining the winners. The photographic component of each of the entries will be judged individually on their merits based on creativity or originality. The best five entries, from all entries received, as determined by the judges, will each receive a prize.
Judging will take place at 16.59 (aest) on 21/06/2010 at 1/132b Gwynne Street Richmond Victoria 3121. Entries will be judged by a panel of judges from the furnace. the judges' decision is final and binding - no correspondence will be entered into.
The entry deemed the best entry by the judges will win an Apple Macbook laptop [part no' mc207x/a] valued at $1299.00, an Apple iPhone 3gs 16gb black [part no' mc131x/a] valued at $879.00 and Vestalife Ladybug ii speakers [part no' tx306m/a] valued at $159.95. The entry deemed the second and the entry deemed the third best entry by the judges will each win a iPhone 3gs 16gb black [part no' mc131x/a] valued at $879.00 each. The entry deemed the fourth and the entry deemed the fifth best entry by the judges will each win a iPod touch 32gb valued at $399.00 plus a $50.00 iTunes gift card. The total prize pool is valued at rrp $4,993.95.
The promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The promoter accepts no responsibility for any variation in prize value. Prize values are the recommended retail price including gst.
Prizes are not transferable and are not redeemable for cash. The promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way. Entries received will be considered final by the promoter.
In the event that any prize becomes unavailable for reasons beyond the promoter's control, the promoter may substitute a prize of equal or greater value.
The winners will be notified by email on or about 23/06/2010.
Entrants can only enter in their own name. The promoter reserves the right to request verification of age, identity, residential address of winners and any other information relevant to entry into or participation in this promotion. Verification is at the discretion of the promoter, whose decision is final. The promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion. The promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Acceptance of a prize is subject to the terms and conditions of Apple inc in respect of the item won. The promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Apple.
The promoter and its associated agencies and companies are not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The promoter and its agents associated with this promotion take no responsibility for a prize (or part of a prize) damaged or lost in transit (if relevant). All warranty claims in regards to a prize should be directed to the applicable manufacturer and not the promoter.
The promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
The promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the promoter including but without limitation technical malfunctions or failures.
If for any reason this promotion is not capable of running as planned for any reason beyond the reasonable control of the promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize or prizes to the same value as an original prize or prizes.
By participating, entrants agree that ownership of any intellectual property rights in their entry is assigned to the promoter. The entrant agrees to sign any further documentation required by the promoter to give effect to this assignment. To the extent permitted by applicable law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in any materials submitted as part of their entry and waive all moral rights in such materials where possible.
Any entries that contain content that the promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will not be considered eligible entries into the promotion. Without limiting any of the provisions of these conditions of entry, the promoter requires that any entry not include or make reference to any visible logos, drawings, cartoons, phrases, trade marks or other third party materials (including but not limited to any copyrighted material, trade mark, logo or mark that identifies a brand) as it could result in a third party subjecting the entrant and/or the promoter to legal liability. The decision to accept or reject an entry as an eligible entry is in the promoter's sole discretion and no correspondence will be entered into.
Any entries that contain content that the promoter, in its sole discretion, considers to be one or more of the following content types will not be considered eligible entries into the promotion:
Content that depicts, alludes to or promotes offensive or illegal behaviour;
Bontent that is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
Content that harasses or advocates harassment of another person;
Content that exploits people in a sexual or violent manner;
Content that contains nudity, violence, or offensive subject matter;
Content that provides any telephone numbers, street addresses, last names, urls or email addresses;
Content that promotes information that entrants know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
Content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
Content that involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
Content that contains any viruses, trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
Content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;
Content that includes an image or reference to another person that you have submitted without that person's consent; or
Content that uses sexually suggestive imagery or any other unfair, misleading or deceptive content.
By entering this promotion, each entrant warrants to the promoter:
That they have the authority and all permissions necessary to submit their entry;
That they own the content of their entry and have the right to assign copyright ownership and other intellectual property rights in the entry to the promoter;
That their entry does not violate the privacy rights, copyright, contract rights or other rights (including but not limited to intellectual property rights) of any person, corporation or entity;
In respect of entries that include images or references to third parties or third party property, that they have, before submitting their entry, obtained the required written consents and releases from those third parties (or third party property owners) to include such images or references in their entry and submit that entry into this promotion;

That their entry does not contain content that is illegal, contrary to any laws, indecent, obscene, threatening, discriminatory, harassing, in breach of any confidence, defamatory, libellous, offensive or objectionable;
That their entry does not contain content that is contrary to the requirements or directions of relevant regulators;
That their entry does not contain content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;
That their entry does not contain content that contains any viruses, trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
That their entry does not contain any misrepresentations or suggestion that any entity has the approval or sponsorship of any other entity which it does not have;
That during the course of creating their entry, their conduct was not illegal, contrary to any laws, indecent, obscene, threatening, discriminatory or harassing to any person; or
That the entrant agrees that if their entry is accepted by the promoter, it may be available on the promoter's website for public viewing and that their entry may be used by the promoter in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising and/or marketing this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the promoter.
Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users. All entries are subject to the healthsuperclub.com.au website prevailing terms and conditions of use (available at healthsuperclub.com.au). The promoter is not responsible and excludes all liability (to the greatest extent allowable by law) for the content of any entries submitted for the purposes of this promotion (including but not limited to any illegal, incorrect or inaccurate content and third party advertising).
As a condition of entering this promotion entrants consent to the promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in the event that they are a winner in any media for an unlimited period of time without further notification, compensation or remuneration for the purpose of promoting, publicising or marketing this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the promoter. An entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the promoter and its agents.
It is a condition of accepting a prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the promoter. Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By participating in the promotion, an entrant also acknowledges that a further primary purpose for collection of the entrant's personal information by the promoter is to enable the promoter to use the information to assist the promoter in improving goods and services and to contact the entrant in the future with information on special offers or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (sms (short message service), mms (multimedia message service), im (instant messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. By entering the promotion, an entrant acknowledges and agrees that the promoter may use the entrant's personal information in the manner set out in this condition.

A copy of the promoter's privacy policy in relation to the treatment of personal information collected may be obtained by contacting the promoter.
In these conditions of entry: "intellectual property rights" means all present and future rights of whatever nature anywhere in the world including, but not limited to, rights in respect of or in connection with copyright, inventions (including patents), trade marks, service marks, trade names, domain names, designs, confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not registered or registrable, and includes the right to apply for the registration of such rights, and whether existing in Australia or otherwise.
